CENSORSHIP II


Here are four comments we received on our “Censorship” problem:

Rumpy: Wake up. From nearly the start, your blog has repeatedly featured attacks against judges, lawyers in the SAO, PD and the private bar. I'm sure that posts which attack a person's job performance and professionalism are, in many instances, taken personally by the person attacked. Worse yet, the attacks are almost always anonymously written. Seems like you only give a damn when the comment affects someone you care about.

Rumpole replies: 1) When you say the blog has featured attacks, we assume you mean from readers. We have criticiszed Judges, but not attacked any. Not to say we won’t when it’s appropriate, but we have not attacked anyone in the manner of which one could interpret our first post on Brummer settling the lawsuit- “Brummer Bummer” an attack on Mr. Brummer. 2) We don’t care about Judge Lefiman’s JA. Hell, we would have trouble picking her out of a lineup. People want to criticize her for selling perfume? Have at it. However, calling her a name based on her appearance is out of line. What can’t you understand about that? As the reader

below who gets it noted, we rarely remove posts. Out of probably close to 700 or a thousand posts so far, we have removed about 5.

I agree with Wake up. Deleting stuff from the blog is a cop out.Isn't all this stuff personal to somebody? Are the insults really ever out of bounds? We're freakin criminal defense lawyers. If a person can't take something being said about him/her, they need togo work civil and sit behind a desk all day. Some of the stuff you've deleted has been the god honest truth. It'sjust that you think it went to far. Leave the BLOG AS iT IS and STOPdeleting comments.

Runmpole tries again to explain it: Listen closely: Call a Judge bad- no problem. Call a Judge ugly – problem. Get it? Call a lawyer incompetent- no problem. Call a lawyer fat (that is hitting a little to close to home for us) problem. Get it? We challenge anyone to point to a post we have deleted that does not meet that guideline. Plus, and this may surprise some people, but we are not professionals about this. We struggle to do the best we can. But we categorically deny any accusation that we have removed posts that were the truth but did it to protect a friend. For Christ sake- we are related to Bennett Brummer and that didn’t stop us (just a joke).

The last comment Rumpole deleted was purely vindictive personal opinion. I hope he will always delete that crap.I should also add that, the percentage of deleted comments is so low as to be essentially irrelevant to reasonable discourse. I mean...he's deleted FIVE! Still, if you think Rumpole has crossed the line, all is not lost. Blogger.com will be happy to give you your own blog. It's free, it's easy to do. Just click the link at the top right of the Blog which says "GET YOUR OWN BLOG."

Runmpole says: Can’t we all just get along? Seriously, why go through all the trouble to write about Judge Leifman’s JA’s actions, which is a perfectly acceptable subject for the blog, and then top the comment off with calling her a name? It undermines the whole post. Truth be known, personally, we like Judge Leifman-although the Marlins have won the world series more times than we have personally appeared before him. He was a good PD. He tries to do good things as a Judge. We hope, if our identity is ever revealed that he would take our calling him Lord Of the Traffic Magistrates in good spirits.

But if you think about it, if our identity was known, and Leifman called us on the phone and said: “listen, I’ve got an election to deal with, can you lay off the blog crap?” It would put us in a difficult situation. So that is why we remain anonymous.

As to another Justice Building Blog, we honestly don’t want other blogs. We think this blog does a great job and we like having readers.

Readers should monitor this issue. We pledge to notify everyone when we remove a post, and if we remove a post- to re-post it, with the offensive parts removed.

PS: none of the above rules apply to anyone who knows anything about PD Rory Stein’s mid-morning snack habits.

Or a prosecutor's home address (which also happens to be a crime?) Free speech? Sure. Call Judge X a moron? No problem. Post their children's names and schools? No way. Call it censorship. We call it common sense. Other than those few rules, anything goes. Ask Bobby Reiff. He took a beating and retired.



See You In Court- Just Not Judge Lefiman’s court. Does he even have a calendar? No wonder he has opposition, it’s a great job.

Sunny Goldin is a pizza eating Benedict Arnold. How do we know you and Jackie didn't stop off at some internet Cafe and do the post? Plus have you ever spent 10 minutes with our child? He is obsessed with our laptop, and no way could I do anything while he was awake. And he was up to 11 that night. Stop stirring up trouble.

AS to the much repeated allegations about me: "waive reading, plea not guilty, trial by jury, discovery, 15 days for motions." In true defense attorney fashion I want the lawyer who is most convinced its me to defend me.

Being the author of the JAPS matter, I agree. I authored the comment about her looks as a cheap shot. It added nothing to the analysis. Sorry. I hope she and Leifman get the point. Basta. His honor should not be spoken and written about in this manner due to someone else's indiscretion. I have moved on. Personally, I hate the service and lines at Perfumania, but what can I do. See Ya there.

Retired? I'm still playing twice a week (or were you referring to my "legal" career?).

It would take many more cheap shots than dished out here for me to retire (I may not skate too fast anymore but I still know where I should be skating to) ... but it did teach me a pointed lesson about the power of anonymous and unfounded (and unwarranted?) posts to stain one's hard-earned reputation.

Bobby Reiff is just overrated and over charges his clients. He is just a good sales guy with a JD. Try a case the next time you charge a client 15K for a first DUI. His book is his sales pitch. I could spend ten thousand dollars and get a book published and BS my cleints that I too was an authority. Judges fall prey to the confusion too. Other attorneys who lack the research and lawyering skills also love the Reiff mystic. But, Bobby props to you buddy. This is a game and your the master of the pitch. Just keep it real sometimes.

what about Robin Blake? What's going on- she took some papers from the familiy and tried to take them inside TGK? Could this happen to any of us or was this really poor judgement. Is this a no action situation or a PTI?

It should be a flat out NO ACTION. Where is the intent? Making a mistake is not a crime. For God's sake, they should not have even arrested her once she said what happened. Charge the family member that gave it to her and call it a day. There is no way she INTENDED to introduce drugs into the jail. Accidents do happen...just ask DICK.

Someone posted the family gave Robin the packages just a few feet from the guards. Hopefully that was caught on tape. It would be even better if the family came clean.

But the reality is that every drug defendant says that someone “put that on me.” I think it might have to be PTI, drug court or a W/H. Thats what a person not in the club would get.

15k for a first DUI? Where the hell do you get these things? 15k in my dreams perhaps, but in reality, I get no where close to that for a first.

Please, if you are going to post this anonymous bullshit, please have the decency to be somewhat accurate.

And about the book ... in case you haven't noticed, it is published by LEXIS Law Publishing Company, one of the largest legal publishing houses in the country, not Fat Joe's Backyard Books. Perhaps it is you who needs to keep it real. But since you post this anonymous bullshit, I guess there is no way for us to guage your trial skills (or if you have even tried a DUI).

I personally have plagiarized several of Reiff's motions. They have all worked quite well . Bobby knows more about Dui than all but a select few ,his clients get their moneys worth whatever he charges.

Ask corrections...those present say you could smell it from across the room...and when the inspecting officer noted the odor, she claimed she smelled nothing.

AND IT WAS 1/2 A POUND!!! Doh!

I don't know the attorney involved in the jail-drug issue but is it possible she knew what she was doing? Maybe she thought she would be able to get away with it? It's interesting to see that most of the comments, presumably from the defense bar, are defending her "i had no idea" defense. Hopefully for her sake if she is innocent there will be video or the COs will back her story.

MOST, certainly not all, but MOST people dealing drugs do it for the money. The cost benefit of dealing drugs often makes sense to people without any hope or cash. Now... I think most people are presuming that Robin Blake wouldn't endanger her career as an attorney just to pass on a bit of herb. It doesn't make sense. That's why we're presuming she made a stupic mistake.

This case should not be automatically dismissed. That would be a bad sign for other would-be mule attorneys. Open your eyes, you're dealing with criminals (alledged). we should be careful.

I ALSO WAS IN COURTROOM 1-2 BEFORE JUDGE SHELLY SCHWARTZ ON THURSDAY,AND ALTHOUGH HE WOULD BE GREAT ON TELEVISION,WE WOULD LOOSE ONE OF THE FAIREST JUDGES WE HAVE.
SHELLY SCHWARTZ IS SHELLY,TO THOSE WHO HAVE KNOWN HIM FOR MANY YEARS. HE WILL DO NO FAVORS,AND TRIES TO BE AS IMPARTIAL AS POSSIBLE.

You say Migda Sanchez is a good attorney and hard working public defehcer.Well from what I see in court few public defenders work very hard.By the way,what is her true name?Is it Sanchez or Llorens?I know Ms.Sanchez a/k/a Llorenz from the fed.p.d.office and she was asked to leave,although it then became mutual so she can have more time for herself.What a surprise coming back to Brummers office.She also is not very pleasant a person to anyone unless she wants something.

Sanchez went from being assistant public defender under Brummer to Kathy Williams office as assistant federal public defender at greatly increased pay.Now she returned to Brummers office.Must ask why so many changes in less than 10 years of practice.we know;less work and more time for self.

Rumpole, I have taken it upon myself to investigate the email caper and my investigation has concluded that the Judges' emails are full of ass kissing, Dolphin talk, offers to babysit, for handyman and just crap. Judge Miller's JA did not make a mistake, she followed the norm. Ask Judge Slom. For what I was allowed to see, unless I was tricked, he seems send the Grease Pit's menu (1st Floor Restaurant in RGJB) via email often to everyone on the RGJB server. No wonder he has no time to have a calendar.

I think I heard this in a bad movie some time ago: "Don't hate the player, hate the game."

Can someone please copy some for everyone to see how ridiculous they are...

Is it true that Judge Ortiz, Judge Krieger Martin and McWhorter call on Judge Slump and Judge Leaveman to know how to rule on cases? For some reason, I keep hearing it from traffic attorneys. Ladies, stop using the lifeline as this is not a game show. Make a decision on your own or resign. It is hard enough to appear before you to have to consider what the other two line Judges would rule like.
