MUBARK RESIGNS (sort of)...POLICE INVADE!

UPDATE: THIS TIME WE MEAN IT. HE'S GONE. MUBARAK RESIGNS.
We have to admit the comments are just too funny to change the post. All in good fun. The investiture was well done, appropriate, short, and touching.


UPDATE: Marbarak has just spoken. He did not resign. He did transfer power to his VP. But he's still around. Sort of like a lesser included jury verdict. No one wins, no one is happy. Unlike a jury verdict, the situation in Egypt cannot last. The people are furious and they will not accept this compromise. The latest rumor is that the protestors will now march on the presidential palace.

The Military was prepared to run the country until elections. Mubarak has apparently lost confidence of some the military leaders. This situation is NOT stable and we could well see a coup. Stand by...(we're going for a run so we suggest you watch your favourite cable TV station for awhile. The most common question is: "how will this affect the investiture tomorrow?"
The answer is that it probably won't.)

Breaking now (Thursday afternoon). Mubarak is resigning. Egyptian Military will take over and run country until elections in September.

Milt Hirsch investiture tomorrow. Not sure of the link between these two historic events.....

Kevin Emas investiture at the 3rd DCA (motto: conveniently located in Kendall) next week. Judge Michelle Paulson-Gonzalez has her investiture March 4. Ms. MPG was the second candidate to replace a sitting judge. Initial reviews on her are positive.

It kills us to write these, but Florida Judges may be under paid as per the Orlando Sentinel.

THE SHAPE OF THINGS TO COME????

This was the REGJB parking lot (what is commonly called "the attorney parking lot" since 99% of the cars belong to attorneys, with the rest comprised of employees in those weird medical buildings that are next to the parking lot.) Hat tip to a long time blog reader who sent us this picture.

Police cars as far as the eye can see. And with all the best spots to boot!




Can defense attorneys and police officers peacefully share a parking lot? Alex Michaels parks in the attorney lot you know.

If Israel and Egypt can have a peace treaty; If President Obama can have lunch with the Republican Leadership; "IF you can keep your head when all about you are losing theirs and blaming it on you...." ***

Next week is reserved for his Honor Kevin Emas and the Investiture will take place at the 3rd DCA aka NOT the Taj Mahal.

More on the judicial qualifications conversation...

The age of the judge doesn't matter in and of itself. In fact, younger judges may be more in touch with the realities of modern practice.

Take Margolis for instance. He's been a judge forever but when he covers calendars, he routinely denies continuances because in his day, cases were filed and brought to trial within 60 days. Getting a second or when your client is facing life in prison is not too much to ask when there are outstanding depos. Younger judges may understand this. Some of the older ones don't.

Experience over age should be the determining factor. Trials, motions, types and number of cases handled is more important. You could have a 7-year attorney with 25 trials or a 30-year attorney with 1 or 2. Who would you rather have hearing your case?

Also, civil practioners should be assigned to civil divisions and criminal practioners to criminal. Don't put lifelong ASAs/PDs in civil, don't put PI lawyers in criminal.

We Pay $90 a month for this parking decal and then can't use it when officers from every dept decide to start parking there. wtf. The mpa says metro dade is allowed all of a sudden to park there. Why? they usually are able to park wherever. Additionally, every f***ing dept in south florida is parking there without permission and those of us with a paid decal find no spots on a Monday morning? driving around for 30 minutes trying to find a space in vain while paying for the privilege is bs.

Why is it that the City Parking authority (that's about to raise rates 25%) allows the cops to park in our spots? It's not bad enough that we have to pay them OT to come and sit in the hallway and fan themselves, but now we have to pay for the privilege of parking in the "atty lot" and see them taking our spaces as well? This city is a joke and it's no wonder that people have little to no respect for law enforcement and the laws. The Government takes, takes and then takes some more. Sorry for the rant, but it's really giving me a case of the red-ass.

I thought the parking switch to the other lot would be painless....forget the fact that the pass card didn't work....I have a nice car. I worked hard for my nice car and will usually try to park it next to other nice cars.

Not a lot of options in the new lot.

off topic - Some of you may know the hotdog lady across from lot 26. I know her because we were pregnant at the same time. Her son would be 4 on Saturday. I say would be, because he died suddely and unexpecatdly about 8 months ago. The death of a child is a great equalizer, whether judge or janitor the devistation is the same.

Additionlly, she has other children who she tried to prepare for the sudden shock of loosing their baby brother by saying he was sick in the hospital when he had actually passed. She collected their get well cards knowing her youngest son would never get them.
Superheros walk amoung us, we just dont see them, sometimes they're selling hot dogs off of lot 26. So if you pass her by maybe buy a hot dog or a coke and help her family out, especially in these difficult days.

1:00 PM. Justice Antonin Scalia presents Mr. Justice Milton Hirsch.

1:15-4:45 remarks by Mr. Justice Milton Hirsch.

4:45-5:00 pm. Intermission.

5:05-5:15 Mormon Tabernacle leads courtroom in song. America the Beautiful, This land is My Land, and Ave Maria.

5:20-6:00PM Yo Yo Ma recital.

6:10-6:30- general public removed from courthouse.

6:40-8:30 sit down black tie formal dinner- Maine Lobster- florida Mango chutney sauce, Stone Crabs, New Zealand Lamb.

9:00pm- Fireworks display Bayside.

9:46 Mr. Justice Hirsch motorcade leaves Courthouse.

10:30 police open I-95, Flagler Street and all other thoroughfares.

Gov. Scott’s budget cuts could hit needy

Scott’s budget includes big tax cuts, but not for everybody House committee OKs jobless benefits cuts Republicans promise $100 billion in spending cuts .
-- Last year, agencies that help Florida’s homeless received nearly $7 million in state funding to assist more than 74,000 people.

But that money was wiped out of the budget unveiled by Gov. Rick Scott on Monday, which called for elimination of the state’s Office of Homelessness.

In addition to cutting the homelessness office, Scott’s budget calls for moving trust funds that pay for indigent criminal defense and domestic violence and rape crisis programs into general revenue coffers.

Not that the facts will matter a damn to you, but Milton Hirsch's investiture -- which was packed -- lasted all of 45 minutes. Besides the official speakers common to every investiture, two of his friends gave brief, deeply personal, entertaining remarks.

He was sworn in by his secretary of 24 years. His wife, daughter, son-in-law and baby granddaughter stood for his robing.

His own address came in at something under six minutes. He spoke of his family, and of service, in a manner as humble and heartfelt as anyone has ever heard in that courtroom.

I watched Ms. Brinkley handle a traffic hearing. I honestly thought that she was a non-lawyer hearing officer. Holy Smokes.

Milt was masterful. Quoting from Pope Pius *=(of course) IV, Charlemagne, Guy De Maupassant, Lord Byron, General Alfred Jodl, Disraeli, Bonaparte, Casey Stengal and Yogi Berra, not to mention Gill Hodges and Rutherford B. Hayes. He invoked Eisenhower's warning against the military industrial complex, Churchill's "we shall never surrender", Gandhi's plea for justice, Martin Luther King ("Injustice anywhere is injustice everywhere") and fifty cent.

Speaking in Yiddish, Latin, French, and the ancient Hopi Language, Hirsch used his time to weigh invective against lawyers who hand up cases, genocide in the Congo, NAFTA, START II, and medical marijuana.

The small prayer ceremony and the blessing in arabic over "a New Egypt" was very touching.

Best thing is to Google "Shumie time" and hold on to your hat.

Remember Pet Rocks? Shumie Time was and is a term that went "viral" about 20 months ago, denoting the belief that a lawyer should work less, leave work early, and generally enjoy life.

A debate rages on the etymological source of the term. Two schools of thought have emerged, both tracing the origins of the term to surfers. The "Hawaiians" trace the term to the North Shore to denote either "time to leave work and go surf" AND?OR the surf is toast, time to leave.

The California School traces the term to Redondo Beach and the texting of the term to high school seniors to book class and go surfing.

From wherever the term emerged it has been conclusively proven the term emerged in Chicago of all places, and for our purposes the term can be traced to a law firm in downtown that used it as code in emails and texts to attorneys and staff as "time to leave for the day. " The police in Chicago also began using the term shortly thereafter to denote leaving work or an investigation that has hit an end, as in "Call it a shumie and move on"

From Chicago the term went viral and as such caught on in Miami, where unfortunately for some lawyer who has the nick name of "shumie" it began to be used with embarrassing frequency, although it has been conclusively proven the term has nothing to do with him or his work habits (he's a fine attorney).

You forgot, in your scholarly comment, to mention that for legal blog purposes in Miami the term is almost exclusively used to denote a lawyer leaving work early, as in "call the shumie, it's 3:45 and I'm going to play the back 9."

However the term also is used to denote an opponents case that has gone to sh&t: as in "man that dude's lawsuit is all shumied up, no way he can win."

Milton Hirsh's investiture was classy. His speach was only about 5 minutes. The inflections in his voice, the content and delivery sounded like an excellent closing argument evidencing that he is an experienced trial attorney. Congratulations to our newest Judge.
