TRAFFICKING UNCONSTITUTIONAL! (but still not legal).

There was some chatter in Tallahassee this past week about upping to ten years as a member of the Florida Bar (from five years) the minimum requirement to be a Judge. If they make it retro-active, the REGJB could empty out quickly. Add a requirement of say ten jury trials and ten appeals and the hallways would be downright lonely.

DRUG TRAFFICKING LAW HELD TO BE UNCONSTITUTIONAL!!!

As per the JAA Broward blog, Judge Carlos Rodriguez has held 893.135(1)(b) UNCONSTITUTIONAL! We done old chap. The order is here. Use it. File motions, spread the word, fight the power.

The rest of the week: Milton Hirsch's coronation investiture is this Friday at the Civil Courthouse. Like the Super Bowl, tickets are at a premium. Word is that if some people cannot be seated ala Dallas this past Sunday, they will get seats in the jury box in the Judge's courtroom for the rest of the month. Wow! What a deal.

Kudos to Judge Ruiz-Cohen for a classy event last week. We expected nothing less.

Rompole, What a concept...that judges we appear before have at legal 10 years legal experience, have tried jury trials and have appellate experience. Who knows the next thing we'll ask is that they be impartial, respectful, civil, decisive, intelligent and easy going. Check out Senate Bill 140 which attempts to ammend the Fla. Constitution to increase the experience to 10 years and the retirement age to 75.

There is also a bill pending to allow defeated judges to work as retired judges. (With conditions) WRITE TO THE SENATORS and tell them no. Just when we get rid of Flora Seff, Peter Adrien and others, we don't need them back.

A requirement of 10 years to be a county court judge is a joke! Perhaps to be a circuit court judge that makes sense. In any event, this is just another example of the good ol boys and girls trying to protect their turf. This all started post Ian Richards winning in Broward as a young unknown and Post Michaelle whatever her hypenated name is winning in Miami.

Rumpole .... JNC INTERVIEWS yesterday and today. Tonight we will have our new list of potential judges ... 2 circuit and 1 county. My opinion:

Any bets? Thoughts? This is to replace judges Emas and Piniero.

I represented Mr. Green in this case, and filed the Motion to Suppress, the Motion to Strike State's Motion in Limine and the Motion to Dismiss. I don't recall Bob Trachman helping me with this case.

I represented Richard Green and filed the Motion to Dismiss. Judge Rodriguez wrote the order and deserves any and all accolades for the content thereof.
